Ethical Obligations of a Lawyer When His Client Has Committed or Intends to Commit Perjury

Regardless of whether the lawyer is representing a civil client or a criminal client, the lawyer’s ethical obligations remain the same. Where a client informs counsel of his intent to commit perjury, a lawyer’s first duty is to attempt to dissuade the client from committing perjury. In doing so, the lawyer should advise the client that if the client insists on committing the proposed perjury then the lawyer will be forced to move to withdraw from representation. The lawyer should further explain that he may be required to disclose the specific reason for withdrawal if required to do so by the court. If the client continues to insist that they will provide false testimony, the lawyer should move to withdraw from representation.

Warning signs of a dishonest lawyer

Last week we answered this question: “If my lawyer rips me off, is there any official organization that can help me be reimbursed?”

As we learned, fortunately California and all state bar Associations have a Client Security Fund. “While a slow process which can take several years, the goal,” observes attorney Lori Meloch, Director of the California State Bar Client Security Fund, “is to compensate clients who have been the victim of the two percent of lawyers who are dishonest.”

Why Is Mesothelioma So Rare?

One of the dangers of getting exposed to asbestos is a type of cancer called mesothelioma. When asbestos fibers stick to the membranes covering your internal organs, it can lead to inflammation to the point that it causes genetic damage and stimulates cancerous growth. Mesothelioma is quite rare, with only around 3,000 new cases annually, according to the Centers for Disease Control and Prevention (CDC). However, it is also a highly aggressive disease that can kill patients in a year if not treated just as vigorously.

What is the Process for a Mesothelioma Settlement?

Asbestos litigation is a unique process, from the date of filing the case to the final judgment. This is because mesothelioma cases tend to have relatively short statutes of limitations (the time in which you’re allowed to file a lawsuit) but long legal procedures.

However, courts generally believe that such cases should be handled with expediency and go forward as quickly as possible, due to the nature of the illness and life expectancy of the claimant. Here are the steps that lead up to your settlement:

Mesothelioma Settlements & Verdicts

The average mesothelioma settlement pays between $1 million and $1.4 million, while the average mesothelioma trial verdict is $2.4 million. Settlements from a mesothelioma claim provide guaranteed compensation to patients or loved ones. Settlement compensation can be paid out in as little as a few months.

What Are Mesothelioma Settlements?

Mesothelioma settlements are one way to conclude a lawsuit. Both personal injury and wrongful death mesothelioma lawsuits can reach settlements.

Through a mesothelioma settlement, manufacturers of asbestos-containing products agree to pay a victim a certain amount of money that is determined through negotiations between the manufacturers’ lawyers and mesothelioma lawyers.

The federal government is returning to a controversial lottery system to distribute coveted sponsorships to reunite immigrant families.

Immigration Minister Marco Mendicino today announced details of the new parent and grandparent sponsorship program. The program will open Oct. 13 for a three-week window when people can fill out online forms to express interest in bringing their relatives to Canada. The program had been suspended due to the global pandemic.

How to improve Canada’s Parents and Grandparents immigration program in 2020

January has typically marked the opening of the window for immigrants to express their interest in sponsoring family under Canada’s Parents and Grandparents Program, or PGP.

However, given the challenges Canada has had managing the PGP and the recent federal election in October, it remains unknown as to when the PGP intake window will open in 2020 and what the application process will look like.

The latest expression of interest period of Canada’s Parents and Grandparents Program on January 28 saw more than 100,000 individuals try to access the required form and only 27,000 get through.

In response to widespread criticism that the process was unfair, Immigration, Refugees and Citizenship Canada (IRCC) said eligible sponsors who did not manage to submit an Interest to Sponsor form on January 28 may still be able to bring their parents and grandparents to Canada on a temporary basis on what’s known as a Super Visa.

It Pays To Have Backup Plans: "Golden Visas" And HNW Americans

(An earlier version of this article appeared last Friday in Family Wealth Report, sister news service to this one. Although written from a US perspective, its relevance is plainly global.)

This news service reported on how former Google head, Eric Schmidt, had acquired a “golden visa” offered by Cyprus, one of many jurisdictions offering citizenship/residency-by-investment programmes. The circumstances are controversial because Cyprus’s programme has been recently suspended following a political scandal. These visa programmes have been attacked for enabling money laundering, although industry figures contest such claims. Dozens of jurisdictions, such as Malta, Spain, Grenada, Mauritius, the UK and even the US offer versions of these arrangements.

“It was a big surprise to me,” she said. “I’m not criminal; I’m just a student.”

Rakhshan, a former Iranian doctoral student in the College of Science, first reapplied for her expired visa in May 2019. The officer told her that her case was settled and she’d be informed about the status of her request soon, she said.
