The experience gained by Shiksha Mitras over the
course of their engagement should obviate the need of obtaining the essential qualification cannot be
accepted for more than one reason. Firstly, the essential qualification must be held by the person on the date of entry into the service. If the entry be preceded by a selection process it is liable to be tested with reference to the date of advertisement.
Viewed from any angle, the Shiksha Mitras did not possess the requisite qualification on either of the relevant cut off dates.
Secondly, the experience that may have been gained by a person has never been construed as a substitute for an essential qualification that is statutorily prescribed. Acceptance of this contention would have grave ramifications, fall
foul of settled precedent on the subject and be against the basic tenets of Article 16 and principles governing public employment.

अभी माननीय उच्त्तम न्यायालय से १ लाख ७२ हजार लोग और उनसे जुड़े परिवारों के लिए कष्ट दाई समय आने वाला है उस वक्त आप दिल्ली के जंतर मंतर या रामलीला मैदान में बाबा हजारे के साथ इसे भी असहिष्णुता कहते दिखेंगे क्यूंकि आप जैसों के लिए न्यायिक आदेश भी असहिष्णुता की श्रेणी में ही आएँगे |
आने वाले उसी मौके के लिए आपको इन लोगों से ये सब कहना चाहिए हमारे अनुसार :
